Walking The Himalayas (Registered to as "Berg Adventures Pvt Ltd") provides an online platform that connects Operators who have knowledge and experience with a particular travel destination or activity with Travellers seeking to experience such destinations and activities (collectively with the Site and Application (each as defined below), the "Services").
The Services are accessible at https://www.walkingthehimalayas.com and any other websites through which Walking The Himalayas makes the Services available (collectively, the "Site") and any related applications (the "Application"). By using the Services, you agree to comply with and be legally bound by the terms and conditions of these Terms of Service ("Terms"), whether or not you become a registered user of the Services. These Terms govern your access to and use of the Site, Application and Services and all Collective Content (defined below) and constitute a binding legal agreement between you and Walking The Himalayas.
THE SERVICES COMPRISE AN ONLINE PLATFORM THROUGH WHICH OPERATORS (DEFINED BELOW) MAY CREATE LISTINGS (DEFINED BELOW) FOR GROUP TOURS (DEFINED BELOW) AND TRAVELLERS (DEFINED BELOW) MAY LEARN ABOUT AND BOOK SUCH GROUP TOURS.
YOU UNDERSTAND AND AGREE THAT Walking The Himalayas IS NOT A PARTY TO ANY AGREEMENTS ENTERED INTO BETWEEN OPERATORS AND TRAVELLERS, NOR IS Walking The Himalayas AN AGENT OR INSURER. WTH (Walking The Himalayas) HAS NO CONTROL OVER THE CONDUCT OF OPERATORS, TRAVELLERS AND OTHER USERS OF THE SERVICES OR ANY GROUP TOURS, AND DISCLAIMS ALL LIABILITY IN THIS REGARD.
"Collective Content" means Member Content and WTH Content. "Content" means text, graphics, images, music, software (excluding the Application), audio, video, information or other materials. "Operator Service provider or Vendor" means a Member who creates a Listing via the Services. "Listing" means an Activity or Tour that is listed by an Operator as available for booking via the Services. "Member" means a person who completes WTH's account registration process, including, but not limited to Operators and Travellers, as described under "Account Registration" below. "Member Content" means all Content that a Member post, uploads, publishes, submits or transmits to be made available through the Services.
"Tax" or "Taxes" mean any sales taxes, value-added taxes (VAT), goods and services taxes (GST) and other similar municipal, state and federal indirect or other withholding and personal or corporate income taxes. "WTH Content" means all Content that WTH makes available through the Services, including any Content licensed from a third party, but excluding Member Content. "Traveller" means a Member who requests a booking of a Group Tour via the Services, or a Member who participates in a Group Tour and is not the Operator for such Tour. Certain portions of the Services (and your access to or use of certain aspects of the Services or Collective Content) may have different terms and conditions posted or may require you to agree with and accept additional terms and conditions. If there is a conflict between these Terms and terms and conditions posted for a specific portion of the Services or Collective Content, the latter terms and conditions will take precedence concerning your use of or access to that portion of the Services, or Collective Content.
YOU ACKNOWLEDGE AND AGREE THAT, BY ACCESSING OR USING THE SERVICES OR BY DOWNLOADING OR POSTING ANY CONTENT FROM OR ON THE SITE, VIA THE APPLICATION OR OTHERWISE THROUGH THE SERVICES YOU ARE INDICATING THAT YOU HAVE READ AND THAT YOU UNDERSTAND AND AGREE TO BE BOUND BY THESE TERMS, WHETHER OR NOT YOU HAVE REGISTERED WITH THE SERVICES. IF YOU DO NOT AGREE TO THESE TERMS, THEN YOU HAVE NO RIGHT TO ACCESS OR USE THE SERVICES, OR COLLECTIVE CONTENT.
If you accept or agree to these Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that company or other legal entity to these Terms and, in such event, "you" and "your" will refer and apply to that company or other legal entity.
WTH reserves the right, at its sole discretion, to modify the Services at any time and without prior notice. If we modify these Terms, we will post the modification on the Site or via the Services or provide you with notice of the modification. We will also update the "Last Updated Date" at the top of these Terms. Any changes will become effective immediately upon your acceptance of the modified Terms, whether by, without limitation, creating a Listing or requesting the booking of a Group Tour. If the modified Terms are not acceptable to you, your only recourse is to cease using the Services.
Bookings and Financial Terms for Travellers
Full payment / Rs.5,000 for Trek / Rs.10,000 for Road Trip / Mountain Expedition to be made in advance at the time of booking
Remaining / Rest Payment to be made before the start of the trip
Booking can be made via NEFT / RTGS / SWIFT / Bank Transfer / Cash
GST @ 5% will be added on all the bookings
The Last Date of the booking will be closed before 04 days before trip departure
Cross confirm the dates and seat availability from our team via mail or call before any online booking/reservation
If any invoice amount is above 2 lacs and mode of payment full or partial is in cash (cash paid at counter or deposited in bank) 1% TCS will be applicable and to be deposited extra on total amount and PAN card copy has to be shared.
Full payment is required as per applicable airfare in case of flight booking
In the event of cancellation of any trip/adventure activity services due to any avoidable/unavoidable reasons, we must be notified the same via mail at firstname.lastname@example.org
Cancellation charges will be effective from the date we receive advice on mail and cancellation charges would be as follows
-Before 30 days: 90% of the total Land Package Cost is refundable
-Between 21−30 days: 75% of the total Land Package Cost is refundable
-Between 11−20 days: 50% of the total Land Package Cost is refundable
-Less than 10 days: No refund
Refund will be processed within 10 working days after the cancellation date.
Cancellation charges will be calculated on gross tour cost and the cancellation charges shall depend on the date of departure and date of cancellation.
No Refund will be payable:
-For any missed/unused services of the tour including the meals due to whatsoever reason
-If services of the tour are modified, varied, amended, cancelled or not utilized.
-If any client decides and/or is required to cancel the tour due to any changes made in Itinerary or trip
-If the client is not satisfied with any service of the operator
Other Terms & Policies
WTH or Berg Adventures OPC Pvt Ltd can change the day-wise tour program/itinerary sequence without any prior notice. It may Change depending upon traffic schedules/restrictions, landslides, flight amendments, weather conditions or any other travel-related unforeseen circumstances.
In case of cancellation of the group from our end due to any unavoidable circumstances, we will either transfer the booking in our other fixed departure trips or refund the complete amount except flight charges if any.
Walking The Himalayas takes utmost care to ensure the safety of its members during any of the adventure programs. However, in the case of any unforeseen mishaps, Walking The Himalayas will not be liable for any injuries caused or for loss of life. All disputes arising due to the above will be subject to the jurisdiction of Ghaziabad only. All participants would be required to sign an Indemnity Form before the start of the program, without which travellers would not be allowed to participate in any of the adventure programs.
The package price does not include – Expenses of personal nature, such as laundry, telephone calls, room service, alcoholic beverages, mini bar charges, tips, portage/ offloading charges during any trip, monument fees, camera fees etc.
Package rates are subject to change without prior notice, Force Majeure events, strikes, fairs, festivals, weather conditions, traffic problems, overbooking of hotels/flights, cancellation/re-routing of flights, closure of / entry restrictions at a place of a visit, etc. We would not be held liable for any refunds/compensation claims arising out of this.
All guests must carry valid photo ID’s (Passport/Driving License/Voter ID Card). PAN Card is not accepted at many places as a valid photo ID.
Walking The Himalayas reserves the right to dismiss any client from the tour due to any form of misbehaviour, unreasonable quarrel or physical/verbal assault affecting a client or any of the Ground Field Staff.
